As per the Migration act, certain terms, conditions and types of visas have been established. According to the condition 8503, on assessing the application, an officer of visa shall be deciding for the application of the condition 8503 with respect to the visa. As stated within this condition, after entering Australia with the grant of a specific period of stay will not be expanded (Australian Government, 2013). As in the case provided, it can be stated that there is no possibility for Kaya to remain in Australia with an extended period as what had been fixed. This condition indicates that no further stay shall be allotted to Kaya. However, it has also been stated by the Immigration Act that if an individual is holding a visa that has been imposed by the condition 8503 and there are changes in the circumstances, the condition can be waived as per restricted circumstances(Australian Government, 2013). These restricted circumstances have been stated in the migration legislation of Australia under Regulation 2.05(4). As this is law, there is no possibility for the department to waive the condition for any other reason. According to this regulation, certain circumstances within which waiving of condition 8503 can be done are as follows (Fact Sheet 52b, 2014):
- As the visa had been granted to the person subjected to compassionate and compelling circumstances being developed:
- Not in control of the person
- That result in massive change to the circumstances of a person
- If previously refused by the minister for waiving the condition, the circumstances being satisfactory for the minister as stated in 1(a) are substantially varying in comparison with those considered previously
- If a request is made by the person in front of the minister for waiving the condition. The request should be in written form
